    Current Law Summary: HB151 limits the damages that can be awarded in a construction defect lawsuit to the actual cost of fixing the defect and other closely related costs such as reasonable temporary housing expenses during the repair of the defect, any reduction in market value cause by the defect, and reasonable and necessary attorney fees.

    Shiloh and Vallejo: The DOI Tale of Two Properties

    California courts have certainly been busy as of late. In particular, challenges abound as to the Department of the Interior (the DOI) and its decisions to take certain parcels of land into trust for the purpose of rendering such parcels eligible for gaming activities by certain California tribes. The DOI Shiloh Parcel Dispute The Shiloh parcel, a tract of land the DOI previously approved as land taken into trust for gaming purposes under the restored lands exception of the Indian Gaming Regulatory Act (IGRA) on behalf of the Koi Nation of Northern California (The Koi), has been the subject of considerable controversy.     A New Tariffs Twist: Aggressive Enforcement of False Claims Act Violations Could Potentially Trip Up Construction Companies

    June 16, 2025 —
    There is a new twist on issues revolving around tariffs potentially impacting general contractors. AGC members Chris Denny, Vice President and Associate General Counsel of Turner Construction Company, and Bob Lizza, Chief Legal Officer, Consigli Construction Co., Inc., highlighted recent developments that could have serious implications for the construction industry. At a recent meeting in Washington, D.C., there was a discussion about growing federal enforcement efforts that contractors should not ignore. It has been publicly reported that the U.S. Department of Justice intends to “aggressively” enforce the False Claims Act (FCA), as Deputy Assistant Attorney General Michael Granston said in a speech at the Federal Bar Association’s annual qui tam conference earlier this year. FCA cases alleging that an importer evaded customs duties by undervaluing imported products, misclassifying imports, or misrepresenting a product’s country of origin are on the rise.     Tampa Office Secures Summary Judgment for Property Owner Client in Trip-and-Fall Lawsuit

    September 15, 2025 —
    Tampa, Fla. (August 15, 2025) - Tampa Partner Nicholas Dareneau recently obtained summary judgment for a property owner client in a trip-and-fall lawsuit, with a Florida judge finding that the condition of the sidewalk over which the plaintiff tripped was not dangerous as a matter of law. The incident in question occurred in December 2022, as the plaintiff was walking to the entrance of a retail store on the client's property. She stepped up onto the sidewalk, walked across pavers and then tripped on a section of concrete, suffering injuries. She proceeded to sue Lewis Brisbois’ property owner client and the store in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County. Ultimately, the plaintiff dropped the store owner from the lawsuit. Read the full story...

    Timely Filed, Wrongly Rejected: Court of Appeal Reinforces Summary Judgment Rights

    August 12, 2025 —
    In CFP BDA, LLC v. Superior Court (2025), the California Court of Appeal, Fourth Appellate District, Division Two (Riverside), issued a published opinion that clarifies a recurring procedural dilemma in civil litigation: whether trial courts may deny a timely motion for summary judgment based solely on local calendaring rules. The Court held they may not. The case arose from a property dispute involving a local airport and neighboring landowners seeking to impose an easement. Petitioners (the airport owners) timely reserved a hearing date for their summary judgment motion and served the motion more than 30 days before trial, in compliance with Code of Civil Procedure section 437c. However, because they filed their moving papers more than 10 court days after reserving the hearing - contrary to Riverside County Local Rule 3310 - the court clerk removed the hearing from calendar. When petitioners moved to have the summary judgment motion specially set or the trial date adjusted, the trial court denied relief without a hearing. Read the full story...

    Contractor Entitled to Defense in Suit Filed by Performance Bond Carrier

    July 08, 2025 —
    Interpreting Kentucky law, the Sixth Circuit determined that the contractor who failed to complete a project was entitled to a defense in an action brought by its performance bond carrier. Phoenix Ins. Co., et al. v. Wehr Constructors, Inc., 2025 U.S, App. LEXIS 9258 (6th Cir. April 18, 2025). Wehr entered into a contract with St. Claire Medical Center to construct a Medical Services Pavilion as an addition to the main hospital facility. A standard form issued by the American Institute of Architects, AIA document form A101-1997, was used. (Construction Agreement). Section 14.2 of the form contained a termination clause that allowed St. Claire to terminate the contract if Wehr committed a "substantial breach," provided that the architect on the project certified that sufficient cause existed (the Termination Clause). If the Termination Clause was invoked, Wehr would not be entitled to the remaining unpaid balance of the contract and St. Claire could seek damages from Wehr if the cost of completing the project exceeded the unpaid balance.
